Data Recovery Service Provider Information

Disclaimer

(a) Your selection of one of the independent and external service providers listed below (“Service Provider”) is at your own risk. You are in no way restricted from selecting a service provider for data recovery services other than those listed below .

(b) Any agreement you reach with a Service Provider for data recovery services is concluded exclusively between you and the Service Provider. Toshiba Electronics Europe GmbH and its affiliates (collectively hereinafter referred to as “TOSHIBA”) will in no event become a party to such agreement.

(c) TOSHIBA MAKES NO WARRANTY, EXPRESS OR IMPLIED, AND EXPRESSLY DISCLAIMS ALL WARRANTIES REGARDING THE SERVICES PROVIDED BY AN INDEPENDENT AND EXTERNAL SERVICE PROVIDER, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY REGARDING THE QUALITY OR RELIABILITY OF THE INDEPENDENT AND EXTERNAL SERVICE PROVIDER’S SERVICES, NON INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

(d) Using data recovery services from a Service Provider will not void the Toshiba Warranty for any external and internal Toshiba hard drive (“hard disk”) granted to an end user who purchased a hard disk (“Toshiba Warranty”). However, if as a result of the data recovery services by the Service Provider the hard disk has been damaged or rendered defective the Toshiba Warranty will not apply to this damage or defect.

(e) In accordance with the Toshiba Warranty TOSHIBA assume no liability for any loss or damages of any kind that relate to, arise out of or result from the performance of services by a Service Provider, including, but not limited to, any loss of or damage to data contained on a Toshiba hard disk, e.g. attributable to misuse or tampering, improper handling or other causes as specified in the Toshiba Warranty. You are responsible for saving (backing up) any data. TOSHIBA does not warrant or cover any financial or other loss, caused by data loss.

(f) Actual conditions of data recovery services are subject to each Service Providers’ web page instructions.
